BY DOWNLOADING THIS PACKAGE, INSTALLING, AND/OR USING THE PROGRAM, YOU ACCEPT THE TERMS OF THIS LICENCE FROM TALL SOFTWARE LTD. 1.LIMITED USE LICENCE: Tall Software Ltd. grants you the non-exclusive, non-transferable, limited right and licence to install and use this Program solely for your personal use. All rights not specifically granted under this Agreement are reserved by Tall software Ltd. This Program is licensed, not sold. Your licence confers no title or ownership in this Program and should not be construed as a sale of any rights in this Program. 2.OWNERSHIP: All title, ownership rights and intellectual property rights in and to this Program and any and all copies thereof (including but not limited to any titles, computer code, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, animation, sounds, musical compositions, audio-visual effects, methods of operation, any related documentation, and "applets" incorporated into this Program) are owned by Tall Software Ltd. or its licensors. This Program is protected by the copyright laws of the United Kingdom, international copyright treaties and conventions and other laws. This Program contains certain licensed materials and Tall Software Ltd.'s licensors may protect their rights in the event of any violoation of this Agreement. 3. DISCLAIMER OF WARRANTY. Software is provided "AS IS," without a warranty of any kind. ALL EXPRESS OR IMPLIED REPRESENTATIONS AND WARRANTIES, CONDITIONS OR OTHER TERMS, INCLUDING ANY IMPLIED TERM OF SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, ARE HEREBY EXCLUDED. 4. LIMITATION OF LIABILITY. TALL SOFTWARE LTD. AND ITS LICENSORS SHALL NOT BE LIABLE IN CONTRACT, TORT OR OTHERWISE FOR ANY DAMAGES SUFFERED BY LICENSEE OR ANY THIRD PARTY AS A RESULT OF USING SOFTWARE. IN NO EVENT WILL TALL SOFTWARE OR ITS LICENSORS BE LIABLE FOR ANY LOST REVENUE, PROFIT OR DATA, OR FOR DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF THE USE OF OR INABILITY TO USE SOFTWARE, EVEN IF TALL SOFTWARE LTD. YOU SHALL NOT: - Exploit this Program or any of its parts commercially. - Sell, rent, lease, licence, distribute or otherwise transfer this Program, or any copies of this Program, without the express prior written consent of Tall Software Ltd. - Reverse engineer, derive source code, modify, decompile, disassemble, or create derivative works of this Program, in whole or in part, save to the limited extent permitted by law. - Remove, disable or circumvent any proprietary notices or labels contained on or within the Program. - Export or re-export this Program or any copy or adaptation in violation of any applicable laws or regulations. 6. This agreement is governed by English law.
